1. GENERAL PROVISIONS
1.1. This document: “Policy regarding the processing and protection of personal data of users of the website www.al.com.ua” (hereinafter – the Policy) was developed in accordance with the Law of Ukraine dated 01.06.2010 No. 2297-VI “On the Protection of Personal Data” and is the main internal document LAW ASSOCIATION “LAW COMPANY “ALPHA-LEGAL” (hereinafter – the Operator), which regulates activities in the field of processing and protection of personal data.
1.2. The policy was developed in order to implement the requirements of the legislation of Ukraine in the field of processing and protection of personal data and is aimed at ensuring protection of the rights and freedoms of a person and a citizen during the processing of his personal data by the Operator, including the protection of the right to privacy, personal and family secrets.
1.3. The policy determines the composition of received and processed personal data, the purposes of collecting and processing personal data, the procedure for storing and transferring personal data, as well as measures implemented by the Operator aimed at protecting personal data.
1.4. This Policy applies to any user information received by the Operator both before and after the approval of the Policy.
1.5. This Policy applies to all information that the Operator can obtain about the user, including when using the website www.al.com.ua.
1.6. Visiting and using the Site means the user’s unconditional consent:
· for the processing of his personal data specified in Article 3 of this Policy for the purposes specified in Article 4 of this Policy;
· With the terms of processing his personal data contained in this Policy.
1.7. In case of disagreement with the terms of processing of personal data by the Operator, the user must stop using the Site.
1.8. This Policy applies only to the website www.al.com.ua. The operator does not control and is not responsible for the collection and processing of personal data by third parties, whose websites the user can go to via the links available on the website www.al.com.ua.
1.9. The operator does not verify the authenticity of personal data provided by the user.
2. BASIC TERMS AND DEFINITIONS
2.1. Operator – LAW ASSOCIATION “ALFA-LEGAL LAW COMPANY”
2.2. The site is a set of web pages placed on the Internet, united by a single address space of the domain www.al.com.ua. The start page of the Site, from which you can access all other web pages of the Site, is located on the Internet at the address www.al.com.ua.
2.3. Personal data – any information relating directly or indirectly to a specific or natural person (subject of personal data).
2.4. Processing of personal data – any action (operation) or set of actions (operations) carried out with the use of automation tools or without the use of such tools with personal data, including collection, recording, systematization, accumulation, storage, clarification (updating, changing) , extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data.
2.5. User is a person who has access to the Site via the Internet and uses the Site.
2.6. Cookies are small pieces of data sent by the web server and stored on the user’s computer, which the web user or web browser sends to the web server in an HTTP request when trying to open a page on the Site.
3. COMPOSITION OF USED AND PROCESSED PERSONAL DATA
3.1. User data received and processed within the framework of this Policy are provided to the Operator in the following ways:
3.1.1. Provided by the user on the Website when filling out the personal data entry forms and may include the following information:
· Name;
· Email address;
3.1.2. Automatically transmitted to the Operator in the process of visiting and using the Site using the software installed on the user’s device (information from cookie files), including: location information; the user’s device type and screen resolution; type, version and language of the operating system installed on the user’s device; the type, version and language of the browser (or other program used to access the Site); IP address; the address of the page from which the user went to the Site (referrer), information about which pages the user opens and which buttons the user presses on the Site.
The site uses Google Analytics – a tracking and web analytics program developed by Google, Inc. (1600 Amphitheater Parkway, Mountain View, CA 94043, USA). Google Analytics uses cookies. Data about the use of the Site (including the IP address) generated by cookies are usually transmitted to and stored by Google servers. Google uses this information to evaluate the use of the Site, compile reports on activities on the Site for the Operator and provide other services related to activities on the Site and on the Internet. 3.2. The operator does not process special categories of personal data related to race, nationality, political views, religious or philosophical beliefs.
4. PURPOSES OF PERSONAL DATA COLLECTION AND PROCESSING
4.1. Collection and processing of user’s personal data specified in clause 3.1.1. of this Policy is carried out by the Operator for the purpose of:
· conclusion and execution of contracts between the Operator and the User;
· communication with the user if necessary, including sending messages, requests and information related to the use of the Site, provision of services;
· processing requests and applications from the user.
4.2. Collection and processing of user’s personal data specified in clause 3.1.2. is carried out by the Operator in order to create statistics that help to understand how users use the Site, which allows to optimize its structure and content, increase the ease of use of the Site.
The user can change the cookie settings at any time and block the automatic transmission of the specified files. Detailed information on the possibilities and methods of transferring cookies is available in the web browser settings. Restrictions on the use of cookies may be reflected in some functions available on the Site’s web pages.
4.3. The processing of personal data that does not meet the purposes of processing specified in clauses 4.1 is not allowed. and 4.2. of this Policy.
5. PURPOSES OF COLLECTION AND PROCESSING OF PERSONAL DATA
5.1. The term of processing the User’s personal data is not limited. The processing procedure can be carried out in any way provided for by the legislation of Ukraine. In particular, with the help of information systems of personal data, which can be maintained automatically or without means of automation.
5.2. The processed personal data is destroyed or depersonalized by the Operator upon achievement of the processing goals or in the case of loss of the need to achieve these goals, as well as when the User withdraws consent to the processing of personal data.
5.3. The User has the right to withdraw consent to the processing of personal data by the Operator at any time by sending a written message to the e-mail address: advokatcompany@gmail.com marked “Revocation of consent to the processing of personal data”. The user’s withdrawal of consent to the processing of personal data causes the destruction of records containing personal data in the personal data processing systems of the Operator, including the deletion of the user’s account on the Site.
5.4. The user has the right to demand from the Operator clarification of his personal data, their blocking or destruction in the event that personal data are incomplete, outdated, inaccurate, illegally obtained or are not necessary for the stated purpose of processing, and also to take other measures provided for by the legislation of Ukraine to protect his rights
5.5. The user’s right to change, delete and block personal information may be limited by the requirements of Ukrainian legislation.
5.6. Regarding the personal data of the user, their confidentiality is preserved, except for the cases established in clause 5.7. of this Policy.
5.7. The operator has the right to transfer the user’s personal data to third parties in the following cases:
5.7.1. The transfer is provided for by Ukrainian or other applicable legislation, within the framework of the established procedure (by court decision, request of law enforcement agencies, etc.);
5.7.2. In order to ensure the possibility of protecting the rights and legitimate interests of the Operator.
5.8. In case of loss or disclosure of personal data, the Operator informs the user about the loss or disclosure of personal data.
6. PROTECTION OF PERSONAL DATA OF USERS
6.1. The operator takes the necessary organizational and technical measures to protect the user’s personal data from illegal or accidental access, destruction, modification, blocking, copying, distribution, as well as from other illegal actions of third parties.
6.2. The website www.al.com.ua has an SSL security certificate, with the help of which information is transmitted between the user and the Operator in an encrypted form, in order to prevent its interception and distortion during transmission.
7. LIABILITY
7.1. In case of non-fulfillment of its obligations, the Operator shall be liable for losses suffered by the user in connection with the improper use of personal data, in accordance with the legislation of Ukraine, except for the cases provided for in 7.2. of this Policy.
7.2. In case of loss or disclosure of the user’s personal data, the Operator is not responsible if this information became public property before its loss or disclosure, or was disclosed by the user himself or with the consent of the user.
8. FINAL PROVISIONS
8.1. The Operator has the right to make changes and additions to this Policy. The new version of the Policy is effective from the moment it is posted on the website www.al.com.ua, unless otherwise provided in the new version of the Policy.
8.2. The current legislation of Ukraine applies to relations in the field of processing and protection of personal data not regulated in this Policy.
